Terms of Use.

These Terms of Use (“Terms”) govern your use of www.thebasketballfirm.com and any related pages, products, and services (together, the “Site”) operated by The Basketball Firm (“The Basketball Firm,” “we,” “us,” or “our”). By using the Site, booking time, or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

• You must be at least 13 years old to use the Site.
• If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.
• Consultations and purchases for anyone under 18 must be booked and paid for by a parent or legal guardian.
• We do not knowingly collect personal information from children under 13. See the Privacy Policy for details.

The Basketball Firm is a decision-making partner throughout the student-athlete journey. Through the Site we offer:

• Consultations: one-on-one time with Todd Wilson, scheduled through the Site at the posted hourly rate.
• The Blueprint Guide to Getting Recruited: available in print and as a digital edition.
• Content: articles, videos, and episodes of the Elevate Your Game podcast.

We may add, change, or discontinue any service at any time.

• No guaranteed outcomes. We do not guarantee recruitment, roster spots, scholarships, financial aid, admission to any school, or any athletic or professional result. Every athlete’s path is different.
• Not an athlete agent. The Basketball Firm does not act as an athlete agent, does not negotiate contracts or NIL deals on anyone’s behalf, and does not market athletes to college coaches for a fee.
• Eligibility is your responsibility. You are responsible for understanding and following the rules of the NCAA, NAIA, NJCAA, your state high school association, and any other governing body. Nothing on the Site is a ruling on your eligibility.
• Not professional advice. Our content and consultations are educational and advisory. They are not legal, financial, tax, medical, or mental health advice. Consult a qualified professional for those needs.
• Testimonials. Testimonials and success stories reflect individual experiences. Your results may differ.

• Consultations are booked through our scheduling tool and paid at the time of booking unless we say otherwise.
• Current pricing is posted on the Site. We may change prices at any time, but changes will not affect sessions already paid for.
• Cancellations and rescheduling: you may cancel or reschedule at least 24 hours before your session for a full refund or a new time. Cancellations with less notice, and missed sessions, are not refundable.
• If we need to cancel, we will offer a new time or a full refund.

Our online store is powered by Shopify. By purchasing, you also agree to the checkout terms shown at purchase.

• Print products: we ship to the address you provide. Risk of loss passes to you on delivery to the carrier. Returns of unused, undamaged print products are accepted within 30 days of delivery; return shipping is your responsibility unless the item arrived damaged or incorrect.
• Digital edition: your purchase gives you a personal, non-transferable, non-exclusive license to access and read the digital Blueprint Guide for your own use. You may not share, forward, post, resell, or distribute the access link or any part of the content. Because digital access is delivered immediately, digital purchases are non-refundable except where required by law.
• Errors: we may correct pricing or description errors and may cancel any order affected by an error, with a full refund.

All content on the Site, including the Blueprint Guide, text, graphics, artwork, logos, videos, podcast episodes, and the design of the Site, is owned by The Basketball Firm, Todd Wilson, Core Prep Press, or our licensors and is protected by copyright, trademark, and other laws. You may view and use the Site for your personal, non-commercial use only. You may not copy, reproduce, modify, distribute, sell, or create derivative works from any content without our written permission.

“The Basketball Firm,” our logo, “Elevate Your Game,” and related names are our trademarks. You may not use them without our written permission.

• You agree that information you provide (forms, bookings, messages) is accurate and that you have the right to share it.
• If you send us ideas, feedback, or suggestions, we may use them without any obligation to you.
• If you submit a testimonial, you grant us permission to publish it, with your name and relevant details, on the Site and in our marketing. You may ask us to remove it at any time.

By providing your email address, you agree that we may contact you about your bookings, purchases, and inquiries. With your consent, we may also send updates and offers. You can unsubscribe from marketing emails at any time using the link in any email.

The Site uses and links to third-party services, including those for payments, scheduling, digital publishing, video, advertising, and partner organizations. We are not responsible for third-party sites or services, their content, or their privacy practices. Your use of them is governed by their own terms.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Share, resell, or distribute paid content or access links.
• Scrape, copy, or harvest content or data from the Site by automated means.
• Interfere with the Site’s security or operation, or attempt to access accounts or systems without permission.
• Impersonate anyone or provide false information.
• Harass, threaten, or abuse Todd Wilson, our team, or other users.

We may suspend or end your access to the Site or our services if you violate these Terms.

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE BASKETBALL FIRM, TODD WILSON, AND OUR OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF OPPORTUNITY, SCHOLARSHIP, ROSTER SPOT, OR ELIGIBILITY, ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless The Basketball Firm, Todd Wilson, and our officers, employees, contractors, and affiliates from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

• These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
• Before filing any claim, you agree to contact us and try to resolve the issue informally for at least 30 days.
• Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Either party may bring an eligible claim in small claims court.

We may update these Terms from time to time. We will post the updated version with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.

• If any part of these Terms is found unenforceable, the rest remains in effect.
• Our failure to enforce any part of these Terms is not a waiver.
• These Terms and the Privacy Policy are the entire agreement between you and us about the Site.
• You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, sale, or reorganization.
